Companion - General Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using the Senifone Companion mobile application ("the App") provided by Senifone ("we", "us", or "our").

1. Acceptance of the terms

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the App.

2. Purpose of the App

The App is intended to support users (such as family members or caregivers) in monitoring Senifone smartphones used by elderly individuals. Key features include:
- Real-time location tracking
- Volume level monitoring
- Viewing Do Not Disturb (DND) status
- Receiving SOS alerts

Some features of the App may require a paid subscription. Details are available within the App.

3. User registration

To access certain features of the App, you must create an account using your name and a valid email address. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

By registering, you confirm that you are at least 16 years old. If the Senifone device is used by a child under the age of 16, the person registering the Companion App confirms that they are the parent or legal guardian of that child and provide consent on their behalf.

4. Device Pairing and Access

Pairing with a Senifone device requires a unique PIN code provided by the device or its administrator. Any unauthorized access attempt is strictly prohibited.

5. Permitted use

You agree not to:
- Use the App for any unlawful, harmful, or offensive purpose
- Disrupt or interfere with the operation of the App or its servers
- Attempt to access other users’ data or devices
- Reverse engineer, decompile, or copy any part of the App
- Use monitoring features without the knowledge and consent of the Senifone device owner

6. Intellectual Property

All content, trademarks, software, and intellectual property rights related to the App are owned by Senifone or its licensors. You may not reproduce, distribute, or create derivative works without prior written permission.

7. Data accuracy and limitations

While we strive to provide accurate and up-to-date information, we do not guarantee:
- The precision of real-time data
- Continuous availability of the services
- Compatibility with all devices

Use of the App is at your own risk.

The App is not a substitute for emergency services. In case of emergency, always contact the relevant emergency services (such as 112). Senifone is not liable for any failure to receive SOS alerts due to connectivity issues, device settings, or other technical factors outside our control.

Senifone shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the App.

8. Termination

We reserve the right to suspend or terminate your account immediately in the event of a serious breach of these Terms, including but not limited to unauthorized access attempts or misuse of monitoring features. In all other cases, we will provide reasonable notice before terminating access to the App.

9. Changes to These Terms

We may update these Terms from time to time. We will notify you of any significant changes via the App or by email. Continued use of the App after such notification constitutes acceptance of the updated Terms.

10. Privacy

Your use of the App is also governed by our [Privacy Policy], which explains how we collect, use, and protect your personal information.

11. Applicable law

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes will be submitted to the competent courts in the Netherlands.
